Dashmap Terms of Service Effective Date: August 19, 2025
PLEASE READ THESE TERMS OF SERVICE ("Terms") CAREFULLY. By creating a Dashmap account or using the Dashmap mobile application and services (collectively, the "Service"), you agree to be bound by these Terms. These Terms constitute a legal agreement between you (the "User") and the provider of Dashmap ("Dashmap", "we", "us", or "our"). If you do not agree to any part of these Terms, you must not use the Service. 1. Acceptance of Terms By accessing or using Dashmap, you acknowledge that you have read, understood, and agree to these Terms and to our Privacy Policy (which is incorporated by reference). You agree to comply with all applicable laws and regulations when using the Service. If you are using Dashmap on behalf of an organization, you represent that you have the authority to bind that organization to these Terms. If you do not accept these Terms, you are not authorized to use the Service. Continued use of Dashmap following any updates to these Terms constitutes acceptance of those changes (see Section 9 on Modifications). 2. User Accounts and Eligibility Account Registration: To use Dashmap, you must create an account and provide accurate, current, and complete information during the registration process. You agree to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at dashmap.io@gmail.com of any unauthorized use of your account or security breach. Eligibility: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create a Dashmap account and use the Service. Users under 18 may only use the Service with involvement and consent of a parent or legal guardian, who must accept these Terms on their behalf. By creating an account, you represent that you meet these eligibility requirements and are not barred from using the Service under any applicable laws. Account Use: Each account is personal to you. You must not share your account with others or allow anyone else to access the Service through your credentials. You may not transfer or assign your account to any other person without our written consent. We reserve the right to refuse registration, suspend, or terminate accounts that we suspect are misused, false, or in violation of these Terms. 3. Subscriptions and Payments Dashmap is offered as a subscription-based service. Some core features may require an active annual paid subscription. By subscribing, you agree to pay the applicable fees and charges for the plan you select, plus any applicable taxes. All fees are stated and payable in the currency disclosed at the point of sale, and you authorize Dashmap (or its authorized payment processor) to charge your provided payment method for all amounts due. Auto-Renewal: Subscriptions automatically renew on an annual basis. This means that at the end of each subscription period, your subscription will automatically renew for an additional one-year term unless you cancel before the renewal date. The renewal date will fall on the anniversary of your initial subscription purchase (unless otherwise specified). We will charge your designated payment method on or around that date for the renewal term. By agreeing to these Terms, you acknowledge and consent to this automatic renewal. If you do not wish for your subscription to renew, you must cancel it in advance (see "Cancellation" below). Cancellation: You may cancel your subscription at any time via your account settings or by contacting our support. If you cancel, your subscription will remain active until the end of your current paid term, but will not auto-renew thereafter. To avoid being charged for the next term, you must cancel before your renewal date. No pro-rated refunds will be provided for cancelling in the middle of a subscription term, except where required by law or explicitly permitted by a special refund policy. For example, if applicable law grants a cooling-off period or we advertise a money-back guarantee for first-time users, we will honor such commitments as described. Aside from those situations, all payments are non-refundable. Payment and Billing: You must provide a valid payment method (e.g. credit card or other accepted payment instrument) and promptly update your payment information if it changes (such as card expiration or billing address changes). If we cannot process payment using your provided method (due to expiration, insufficient funds, or otherwise), we may suspend or downgrade your access to paid features until you update your payment details and the charges are successfully processed. You are responsible for any charges or fees incurred due to failed payment attempts (such as bank fees). Price Changes: Dashmap reserves the right to change subscription fees or introduce new charges. If the price of your subscription is increased, we will provide you with reasonable advance notice via the email associated with your account or via in-app notification. Price changes will apply at the start of the next subscription term following the notice. If you do not agree to a fee change, you may cancel your subscription before the new pricing takes effect. Continued use of the Service after the price change becomes effective constitutes your acceptance of the new price. Taxes: Subscription fees are exclusive of any taxes, levies, or duties imposed by taxing authorities, unless stated otherwise. You are responsible for any such applicable taxes (e.g. sales, use, VAT) payable on the subscriptions or services, other than taxes on Dashmaps income. If we have the legal obligation to pay or collect taxes for which you are responsible, we will add such taxes to the charges billed to you. Third-Party App Stores: If you subscribed to Dashmap through a third-party app store or platform (such as Apple App Store or Google Play), additional terms from that platform may apply. For example, billing, cancellations, and refunds may be governed by the third-party stores policies. Dashmap is not responsible for the platforms processes, and any payments handled through such third parties are subject to their terms. In the event of any inconsistencies between these Terms and the third-partys terms (for subscriptions purchased through them), the third-party terms may take precedence regarding payment matters. 4. Use of the App and Restrictions Dashmap grants you a limited, non-transferable, non-exclusive license to install and use the Dashmap mobile application and services for your personal, lawful, non-commercial use, in accordance with these Terms. All rights not expressly granted to you are reserved by Dashmap. Permitted Use: You agree to use the Service only for its intended purpose for example, as a personal safety and navigation aid that collects data and emergency footage for your benefit. You must use the app in compliance with all road safety and traffic laws if operating a vehicle; always practice caution and do not allow the app to distract you from driving or other responsibilities. Prohibited Uses: You must not, and agree not to permit any other person to, use Dashmap or any part of the Service in a manner that: Violates Laws or Rights: Breaches any applicable law or regulation, or infringes the rights of any third party (including intellectual property, privacy, and publicity rights). This includes not using the Service to record or distribute content without proper authorization where required by law. Illegal or Harmful Purposes: Uses the Service for any unlawful, harmful, fraudulent, harassing, stalking, threatening, or abusive purpose (for example, you must not use Dashmaps features to intimidate or improperly surveil someone). Interference and Disruption: Interferes with or disrupts the operation of the Service or the networks or systems connected to the Service. You must not introduce viruses, worms, malware, or any other harmful code, or do anything that imposes an unreasonable or disproportionately large load on our infrastructure. Unauthorized Access: Seeks to gain unauthorized access to the Service or its related systems or networks, or to other users accounts or data. You may not attempt to probe, scan, or test the vulnerability of any Dashmap system or network or breach any security or authentication measures. Reverse Engineering: Copies, modifies, adapts, translates, makes derivative works of, disassembles, decompiles, or reverse engineers any part of the Dashmap software or Service (except as allowed by law or open-source licenses, if applicable), nor attempt to extract the source code of the software. Commercial Exploitation: Sells, resells, rents, leases, or commercially exploits the Service or access to it, unless expressly permitted by Dashmap in writing. You also may not use the Service to advertise or transmit any commercial solicitations, spam, or unauthorized promotional materials. Impersonation or Misrepresentation: Impersonates any person or entity, or falsely states or misrepresents your identity or affiliations (including pretending to be a Dashmap representative or falsely implying endorsement by Dashmap). Data Mining: Uses any automated means (such as bots, scrapers, or spiders) to monitor, extract or collect information from the Service, or to access the Service other than through our published interface and instructions. User Responsibility: You are responsible for your conduct and content while using Dashmap. Any violation of the above restrictions may result in suspension or termination of your account without notice (see also Section 9). Dashmap reserves the right (but is not obligated) to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these Terms, including removing offending content, suspending or terminating accounts, and reporting you to law enforcement if laws are broken. 5. Data Collection and Privacy Your privacy is important to us. Dashmap collects and uses personal data as needed to operate and improve the Service and its safety features. This may include information you provide when creating an account (such as your name, contact information), location data, usage and telemetry data from the app, and emergency-related data (such as video or audio recordings, sensor information, and incident details when an emergency feature is triggered). By using the Service, you consent to Dashmaps collection, use, processing, and disclosure of your data as described in these Terms and in our Privacy Policy. We will use your data to provide the Services functionality (for example, using your location to map your route or to share with emergency contacts when needed), to enhance safety features (such as crash detection or emergency alerts), and to improve the apps performance and user experience. We implement industry-standard security measures to protect your data; however, you understand that no method of data transmission or storage is 100% secure, and we cannot guarantee absolute security of your information. Dashmap may share certain data with third parties in limited circumstances: for instance, with service providers who assist us in operating the Service (under strict data protection obligations), with your designated emergency contacts or professional emergency responders (when an emergency event is detected and such sharing is necessary), or if required by law (such as responding to valid legal process or to protect safety, rights, and property). For full details on how we handle personal information, please review our Privacy Policy. If you do not agree with our data practices, please do not use Dashmap. Because Dashmap is a global service, your data may be processed on servers located in countries outside of your home jurisdiction. These countries may have data protection laws different from your country. By using the Service or providing information to us, you acknowledge and agree that your information may be transferred to and processed in jurisdictions other than your own. We will take steps to ensure your data is handled securely and in accordance with our Privacy Policy wherever it is processed. 6. Emergency Footage and Consent Dashmap offers safety features designed to help in emergency situations. These features may include, for example, automatic crash detection, SOS alerts, and the capture of audio, video, or photographic footage ("Emergency Footage") from your devices camera/microphone when an incident or emergency is detected or when you manually trigger an emergency mode. This section explains how those features work and the permissions and consents you grant by using them. Consent to Record and Share: By enabling or using Dashmaps emergency features, you expressly consent to the recording and collection of Emergency Footage and related data from your device during emergency events. You also consent to Dashmap storing that footage and data on our servers and, as appropriate, sharing it with your designated emergency contacts and/or with emergency service providers (such as 911 responders or other local authorities), but only for the purpose of assisting you in that emergency. For example, if the app detects a severe car accident or you activate an SOS alert, Dashmap may automatically record short video clips or audio, gather your GPS location and other sensor data, and send an alert with that information to your pre-selected emergency contacts and/or to an emergency monitoring center partnered with Dashmap (if applicable). Do not use these features unless you are comfortable with this data being captured and shared in urgent situations. Use and Handling of Emergency Footage: We understand that Emergency Footage may be sensitive. Dashmap will only access and use emergency recordings and data for safety purposes: to facilitate emergency assistance, to analyze and improve the effectiveness of our safety features, and as otherwise described in our Privacy Policy. We will not use Emergency Footage for marketing or other unrelated purposes without your explicit consent. Emergency Footage is stored securely and is subject to retention policies we will retain it only as long as necessary for the purposes for which it was collected, and in accordance with applicable law. You retain ownership of any Emergency Footage of yourself that is captured; however, you grant Dashmap a license to use that footage and data as needed to provide the Service (see Section 7 on Intellectual Property for details of this license). Designating Emergency Contacts: The Service may allow you to provide contact information for family or friends as emergency contacts. If you choose to do so, you are responsible for obtaining any consent from those individuals to receive your emergency alerts or data. By listing someone as an emergency contact, you confirm that you have the right to share your information with them. Dashmap will send your emergency contacts alerts and information only in emergency scenarios (for example, an SMS or email with your location and a notification that Dashmap detected an incident). If an emergency contact no longer should receive such information (for instance, if they are no longer a trusted contact), it is your responsibility to update or remove them from your Dashmap settings. Not a Substitute for Emergency Services: While Dashmaps safety features are designed to assist you, Dashmap is not a replacement for official emergency services. Always use your best judgment and contact police, fire, medical, or other relevant authorities directly in the event of an emergency. Dashmap does not guarantee that emergency responders will receive or respond to any alert or that Emergency Footage will be monitored in real-time. You should always dial your local emergency number (e.g., 911, 112) when you need immediate help. The Services functionality may depend on network connectivity, device capabilities, and third-party services, and thus may not function in all circumstances. Dashmap is not liable for any failure or delay of the emergency features to contact help or mitigate an incident (see Section 8 for Disclaimers). By using Dashmap, you acknowledge these limitations and agree not to solely rely on the app for your safety. 7. Intellectual Property Ownership of Dashmap Materials: All content and materials provided through the Service, including but not limited to the mobile application software, websites, design elements, text, graphics, logos, images, videos (except Emergency Footage provided by users), software code, algorithms, and trademarks ("Dashmap Materials"), are the intellectual property of Dashmap or its licensors. Dashmap (and its licensors, if applicable) retain all rights, title, and interest in and to Dashmap Materials. These are protected by copyright, trademark, patent, and other intellectual property laws. Nothing in these Terms transfers any ownership of Dashmaps intellectual property to you. You are only granted a limited right to use Dashmap Materials as part of the Service for your personal use, under the conditions of these Terms. You may not use Dashmaps name, logos, or any trademarks without our prior written consent, except as necessary for you to use the Service in accordance with these Terms. All trademarks, logos, and service marks displayed on the Service are the property of their respective owners. Dashmaps name, logo, and other marks identified with our Service are our trademarks and may not be used without our express written permission. License to Use the Service: Subject to your compliance with these Terms, Dashmap grants you a personal, worldwide, revocable, non-transferable, non-sublicensable, non-exclusive license to download, install, and run the Dashmap app on your device, and to access the Service, solely for your own personal and non-commercial use. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Service as provided by Dashmap, in the manner permitted by these Terms. You agree not to copy, reproduce, distribute, modify, publicly display, or create derivative works of any of the Dashmap Materials (except for your own User Content, defined below) without our prior written consent. Any unauthorized use of Dashmaps intellectual property or the Service will terminate the license granted by these Terms. User Content and License to Dashmap: "User Content" means any information, data, or material that you submit, upload, transmit, or create using the Service. This includes, for example, profile information, feedback, suggestions you provide to us, and Emergency Footage or other data generated during your use of the safety features. You retain ownership of all User Content that you create or provide Dashmap does not claim ownership of your personal content. However, by providing User Content through the Service, you grant Dashmap a worldwide, royalty-free, sublicensable, transferable, non-exclusive license to use, reproduce, adapt, modify, distribute, translate, create derivative works from, publish, and display your User Content but solely for the purposes of operating and improving the Service and as otherwise authorized by our Privacy Policy. For clarity, this license enables us, for example, to process and transmit your Emergency Footage to your emergency contacts or to store your data on our servers, and to analyze usage or incidents to enhance Dashmaps features. We will not use your User Content for any purposes other than providing the Service, improving it, developing new features, and as necessary to comply with law or enforce our rights. You represent and warrant that you have all necessary rights to submit or share any User Content you provide and to grant the above license. You are solely responsible for your User Content, and for ensuring it does not violate any laws or infringe anyones rights. We do not routinely monitor User Content, but we reserve the right to remove or delete any User Content from the Service at our discretion if we believe it violates these Terms or is otherwise objectionable. Feedback: If you send us any feedback, comments, or suggestions for improvements to Dashmap ("Feedback"), you acknowledge that such Feedback is voluntary and we are free to use it as we see fit, without any obligation to you. We may incorporate your Feedback into Dashmap or our future products or services without providing compensation to you, and you grant Dashmap a perpetual, irrevocable, sublicensable, worldwide license to use and publish the Feedback in any manner. 8. Disclaimer of Warranties and Limitation of Liability No Warranties: The Dashmap Service (including the app, any content, and all features) is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied. To the fullest extent permitted by applicable law, Dashmap (and its parent, affiliates, suppliers, and partners) disclaim all warranties and representations, whether express, implied, or statutory, including but not limited to any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or completely secure; that defects will be corrected; or that the Service will meet your needs or expectations. Dashmap does not guarantee the accuracy, timeliness, or reliability of any information obtained through the Service (for example, we do not guarantee that location data or emergency detection will always be precise or that alerts will reach their intended recipients without delay). You use the Service at your own risk. You assume full responsibility for any consequences that arise from your use of Dashmap. No advice or information, whether oral or written, obtained from Dashmap or through the Service, shall create any warranty not expressly made herein. Limitation of Liability: To the maximum extent permitted by law, in no event shall Dashmap or its affiliates, licensors, partners, employees, or agents be liable to you for any indirect, incidental, special, consequential, or punitive damages whatsoever, including but not limited to damages for lost profits, lost savings or revenue, loss of data, loss of use, loss of goodwill, or other intangible losses, arising out of or related to your use of or inability to use the Service or any content on the Service, even if Dashmap has been advised of the possibility of such damages. In addition, to the extent permitted by law, Dashmaps total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Service will not exceed the amount (if any) that you paid to Dashmap for the Service in the twelve (12) months immediately prior to the event giving rise to the claim. If you have not paid Dashmap any amounts in that period (for example, if you are using a free version of the Service), Dashmaps sole liability will be limited to fifty U.S. dollars (USD $50). The limitations above apply regardless of the legal theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if a limited remedy fails of its essential purpose. Because some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities (for example, in relation to death or personal injury caused by negligence, or fraud), some of the above exclusions or limitations may not apply to you. In such jurisdictions, Dashmaps liability will be limited to the greatest extent permitted by law. Safety Features Disclaimer: You acknowledge that Dashmaps emergency and safety features (including but not limited to crash detection, SOS alerts, and Emergency Footage recording) cannot guarantee prevention of harm or guarantee assistance. Dashmap is not liable for the outcome of any situation during which you used (or attempted to use) the Services emergency features. This includes any failure of the Service to detect an incident or to successfully contact emergency responders or contacts on your behalf. Dashmap does not itself provide emergency response services; it is a facilitator of information to help you in emergencies. Ultimate responsibility for obtaining help lies with you and local emergency services. Dashmap shall not be responsible for any delay, failure, or error in transmitting information to any third party during an emergency, to the extent such issues are outside our reasonable control (for example, due to cellular network outages or incorrect contact information provided by you). You acknowledge and agree that the foregoing disclaimers and limitations of liability are a fundamental basis of the bargain between you and Dashmap, and that Dashmap would not be able to provide the Service on an economically feasible basis without such limitations. 9. Modifications to the Service or Terms Changes to the Service: Dashmap is continually evolving, and we may from time to time add, remove, or modify features, functionalities, or offerings of the Service. We reserve the right to modify, suspend, or discontinue the Service (in whole or in part) at any time, temporarily or permanently, with or without notice. For example, we may release updates that change the apps interface or how certain features work, or we might retire a feature that is no longer feasible. You agree that Dashmap shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. If a change or discontinuation of the Service materially affects your use of a paid subscription, we may, at our discretion, offer a pro-rated refund or alternative compensation, but we are not obligated to do so except as required by law. Changes to Terms: We may revise or update these Terms from time to time. If we make material changes, we will provide notice to you by posting the updated Terms on our website or through the app and updating the "Effective Date" at the top, or by other reasonable means. In some cases, we may also notify you via email or in-app notification. It is your responsibility to review these Terms periodically. The updated Terms will become effective on the date posted (or a later date if indicated in the notice). By continuing to use the Service after the new Terms take effect, you agree to be bound by the revised Terms. If you do not agree to any updated Terms, you must stop using the Service and, if applicable, cancel your subscription. No unilateral amendment will retroactively change dispute resolution provisions for ongoing disputes unless you expressly agree. 10. Governing Law and Dispute Resolution Governing Law: These Terms and any dispute or claim arising out of or in connection with the Service or these Terms (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law principles. (If you are a consumer in a jurisdiction with mandatory consumer protection laws, nothing in this paragraph will affect any rights you have under those mandatory laws.) Dispute Resolution: We value our relationship with users and aim to resolve any concerns through our support team. If you have an issue or dispute with Dashmap, you agree to first contact us at support@dashmap.com and attempt to resolve the dispute informally. In the unlikely event that we cannot resolve a dispute amicably, the following provisions will apply. All disputes, lawsuits, or claims arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the courts of [Jurisdiction] (for example, the state or country in which Dashmaps headquarters is located, as specified above), and you and Dashmap each consent to the personal jurisdiction of those courts. You agree to waive any objections to venue in those courts, even if they are not the courts of your home jurisdiction. If [Jurisdiction] is within the United States, you and Dashmap waive any right to a jury trial in any litigation. Class Action Waiver: To the extent permitted by law, any dispute will be resolved on an individual basis only. You may only resolve disputes with us one-on-one, and may not bring a claim as a plaintiff or class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations or actions are not allowed. If any portion of this Governing Law and Dispute Resolution section is found to be unenforceable, that portion shall be severed and the remainder will remain in full force and effect. 11. Thank you for choosing Dashmap. Your safety and trust are important to us. By using Dashmap, you acknowledge that you have read and agree to these Terms of Service.
